Position of Denmark on the Commission Regulation amending
Annex XVII to The REACH Regulation as regards lead and its
compounds in PVC.
On the 16. November 2022, the Commission launched the written procedure to
obtain the opinion of the REACH Committee on the Commission Regulation
amending Annex XVII to Regulation (EC) No 1907/2002 of the European
Parliament and of the Council as regards lead and its compounds in PVC.
Due to a procedural mistake, Denmark missed the voting deadline of 7 December
2022. We recognise the Rules of Procedure of the REACH Committee meaning
that Denmark in the vote is counted as having given a tacit agreement to the
proposed act.
However, Denmark intended to express a negative reply and vote
against the proposal.
We are aware that the Danish vote would not have changed the outcome of the
voting and the positive opinion by the REACH Committee to the proposal.
We kindly ask the Commission to
- acknowledge the Danish position as expressed by this letter by uploading
the letter to CIRCABC thus also informing the other Member States
- note in the minutes of the REACH Committee that the Commission
received the Danish opinion after the formal deadline was expired,
Furthermore, Denmark would appreciate if the Commission will inform the
Council and the Parliament when they you send the proposal for scrutiny together
with the outcome of the vote in the Committee.
We apologise for any inconvenience the lack of Danish vote within the deadline
and this letter may cause you.
